1. Introduction & Acceptance of Terms

Welcome to The Fix Production Co. (“The Fix,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our services, website, booking systems, communication channels, and any related platforms operated by The Fix Production Co.

By booking a session, purchasing services, accessing our website, or otherwise engaging with us, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cancellation & Rescheduling Policy.

If you do not agree to these Terms, you may not use our services.

2. Eligibility to Use Services

Our services are available to individuals who:

• Are at least 18 years of age, or

• Are accompanied by and have consent from a parent or legal guardian

We reserve the right to refuse service to anyone who does not meet these eligibility requirements.

3. Services Offered

The Fix Production Co. provides, but is not limited to:

• Mobile music production services

• Studio recording sessions

• EP production and “Straight Drop” packages

• Audio engineering, mixing, and mastering

• Media production, photography, and promotional services

• Distribution, marketing, and podcasting services where applicable

We reserve the right to modify, suspend, or discontinue any service offering at any time without prior notice.

4. Bookings, Payments & Deposits

A. Booking Confirmation

All sessions and services require confirmation through our approved booking platforms or communication channels.

B. Payments

We may accept various forms of payment, including but not limited to:

• Electronic payments

• Invoices

• Third-party payment processors

Full payment or a required deposit must be received prior to the start of services unless otherwise agreed in writing.

C. Deposits

Deposits are non-refundable, except where required by applicable law, and are used to secure your scheduled session.

5. Cancellation & Rescheduling Policy

By booking with The Fix Production Co., you agree to the following:

• Cancellations made less than 8 hours before a scheduled session result in forfeiture of the deposit

• Clients are allowed a maximum of two (2) consecutive reschedules

• Excessive rescheduling may result in a one-week booking restriction

• Repeated cancellations or no-shows may result in denial of future bookings

We reserve the right to track booking behavior to enforce these policies fairly and consistently.

6. Right to Refuse or Deny Service

The Fix Production Co. reserves the right to:

• Refuse service

• Cancel sessions

• Deny future bookings

This includes, but is not limited to, situations involving:

• Repeated cancellations or no-shows

• Abusive, threatening, or inappropriate behavior

• Violation of these Terms

• Failure to comply with payment obligations

Such actions may be taken without refund where legally permitted.

7. Intellectual Property & Media Rights

A. Client Content

Clients retain ownership of their original creative content unless otherwise agreed in writing.

B. Promotional Use

By engaging our services, you grant The Fix Production Co. permission to use excerpts of audio, video, images, behind-the-scenes content, and related media for:

• Portfolio use

• Marketing

• Promotional purposes

This consent may be revoked in writing, except where content has already been published or contractually licensed.

C. Company Materials

All branding, logos, website content, and proprietary materials owned by The Fix Production Co. may not be copied, distributed, or used without express written permission.

8. Privacy & Data Use

We collect, store, and use personal information in accordance with our Privacy Policy. Information may include contact details, booking data, payment records, and media files.

We do not sell or rent personal information. Data is used solely for operational, legal, and business purposes consistent with Georgia state and U.S. federal laws.

9. Third-Party Services & Links

Our services may involve third-party platforms, including payment processors, distribution services, and social media platforms. We are not responsible for the content, security, or privacy practices of third-party websites or services.

Use of third-party services is at your own risk.

10. Disclaimers & No Guarantees

• Creative results are subjective and no specific outcome, success level, or distribution performance is guaranteed

• We do not guarantee uninterrupted access to our website or services

• Services are provided “as is” and “as available” to the fullest extent permitted by law

11. Limitation of Liability

To the maximum extent permitted under Georgia and U.S. federal law, The Fix Production Co. shall not be liable for:

• Indirect or consequential damages

• Loss of data, income, or business opportunities

• Technical failures outside our control

Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by and interpreted in accordance with:

• The laws of the State of Georgia

• Applicable United States federal laws

Any disputes shall be resolved exclusively in the courts located within the State of Georgia.

Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
